BIO

John W. McIlvaine III has extensive experience in patent procurement, patent enforcement, trademark registration, trademark enforcement, licensing, and litigation. John's practice involves a substantial amount of international intellectual property law. John counsels a wide range of clients – from individual inventors to Fortune 500 companies.

John has served as a mediator, neutral evaluator, special master, and patent-law expert witness in numerous IP litigation matters in his home district (Western District of PA) and in other districts. John has appeared as counsel in numerous U.S. district court, TTAB and PTAB proceedings, as well as proceedings in the ITC. John has extensive experience representing clients in patent and trademark matters pertaining to water and wastewater, solar panel mounting, packaging, flooring, supplements and nutrition, AAC (Augmentative and Alternative Communication), biotech, retail convenience, lighting, animal containment, tire manufacturing, banking, machine tools, firearms and munitions, foods, youth sports, building materials, robotics, fitness equipment, oil and gas, and various types of software systems. This experience includes filing and prosecuting U.S. and international patent and trademark applications, administrative proceedings, litigation, alternative dispute resolution, opinions, such as patent freedom-to-operate and trademark clearance, cease and desist matters, and transactions and licensing involving intellectual property.

John has been recognized by his peers in the Chambers USA America's Leading Lawyers for Business, and in the 2026 edition of The Best Lawyers in America® for his high caliber work in Litigation - Intellectual Property, Litigation - Patent, Copyright Law, and Patent Law. John has held leadership positions in many bar associations since he was a young lawyer. John has given back to his profession and the community by helping educate the next generation of lawyers as an adjunct professor of patent litigation at the University of Pittsburgh School of Law and by serving on the board of trustees for his local independent health system.
